These Order Terms & Conditions apply to all work orders, purchase orders, service requests, and contracts entered into with Winstar Engineer. By placing an order with us, the client agrees to the following terms:

1. Scope of Work

All orders shall be executed strictly as per the mutually agreed scope, specifications, drawings, BOQ, and technical requirements related to:

  • Electrical Engineering (HT & LT)

  • Data & Communication Systems

  • Security Systems

  • Integrated Building Management Systems (IBMS)

Any modification or additional work beyond the agreed scope shall be treated as a variation and may attract additional cost and time.

2. Order Confirmation

An order shall be considered confirmed only upon written acceptance by Winstar Engineer through email, work order acknowledgment, or formal agreement.

3. Pricing & Taxes

All prices are quoted as per the agreed proposal and are exclusive of applicable taxes, duties, or statutory levies unless stated otherwise. Taxes shall be charged as per prevailing government regulations.

4. Payment Terms

Payment terms shall be as agreed in the work order or contract. Delayed payments may attract interest or may result in suspension of work until payments are cleared.

5. Delivery & Execution

Project timelines are based on site readiness, timely approvals, availability of materials, and client cooperation. Winstar Engineer shall not be liable for delays caused due to factors beyond its control.

6. Materials & Ownership

Materials supplied by Winstar Engineer shall remain our property until full payment is received. Risk shall transfer to the client upon delivery or installation at site.

7. Client Responsibilities

The client shall ensure:

  • Site readiness and safe working conditions

  • Timely approvals and access to site

  • Availability of power, water, and other essentials required for execution

Any delay due to client-side issues may impact timelines and costs.

8. Warranty

Warranty on workmanship or materials, if applicable, shall be as per the agreed contract terms and manufacturer guidelines. Warranty does not cover misuse, negligence, or unauthorized modifications.

9. Cancellation & Termination

Order cancellation by the client must be in writing. Costs incurred till the date of cancellation, including materials procured and work completed, shall be payable to Winstar Engineer.

10. Limitation of Liability

Winstar Engineer’s liability shall be limited to the value of the order. We shall not be responsible for indirect, incidental, or consequential damages.

11. Confidentiality

All technical, commercial, and project-related information shared between the parties shall be treated as confidential.

12. Force Majeure

Winstar Engineer shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, government actions, labor issues, or supply disruptions.

13. Governing Law

These Order Terms & Conditions shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of Indian courts.
